1. INTRODUCTION AND AGREEMENT

This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of MOBICELL services.

Welcome to MOBICELL INDIA PRIVATE LIMITED ("Company", "We", "Us", or "Our"). By accessing our website or using our application and related services ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").

2. DEFINITIONS

• "User" refers to any person, retailer, or distributor who accesses or uses the Services.
• "Wallet" refers to the digital pre-paid balance maintained by the User for performing transactions.
• "Services" refers to Mobile Recharges, DTH, BBPS (Bill Payments), DMT (Domestic Money Transfer), AePS (Aadhaar Enabled Payment System), and Identity Verifications.
• "Transaction" refers to any financial or digital activity performed through the MOBICELL platform.

3. ELIGIBILITY AND REGISTRATION

To use our Services, you must be a resident of India and at least 18 years of age. You represent and warrant that you have the right, authority, and capacity to enter into this Agreement. During registration, you must provide accurate, current, and complete information as prompted by our registration form (including KYC details).

You are solely responsible for all activity that occurs on your account, and you must keep your login credentials and T-PIN secure. The Company will not be liable for any loss that you may incur as a result of someone else using your password or account.

4. SERVICE-SPECIFIC TERMS

A. Recharges and Bill Payments (BBPS)

MOBICELL acts as an intermediary connecting you with cellular service providers and utility operators. We are not responsible for any delay, pricing change, or service interruption caused by the service provider. All recharge and bill payment transactions are final and non-refundable once successfully processed by the operator.

B. Domestic Money Transfer (DMT)

DMT services are provided in adherence to Reserve Bank of India (RBI) guidelines. Users must ensure that beneficiary details (Account Number and IFSC) are 100% accurate. The Company is not liable for funds transferred to an incorrect account due to User error. Standard transaction fees apply.

C. Aadhaar Enabled Payment System (AePS)

AePS transactions require biometric authentication. Users must comply with UIDAI and NPCI norms. Suspicious or fractional transactions (Split-Transactions) are strictly prohibited and may result in immediate account termination and legal action.

D. Identity and Verification Services

Verification services (PAN, Aadhaar, GST, etc.) are for informational purposes based on the data provided by official Government repositories. The Company does not guarantee the 100% uptime of Government servers.

5. WALLET USAGE AND REFUND POLICY

Funds added to the Wallet are non-transferable to other users and cannot be withdrawn to a bank account except where explicitly permitted under specific payout services. In case of a "Failed" transaction where money is debited from the Wallet but the service is not rendered, the amount will be credited back to the Wallet within 24 to 72 business hours.

6. PROHIBITED CONDUCT

You shall not use the Services for any illegal or fraudulent activities, including but not limited to money laundering, funding of terrorism, or unauthorized access to other systems. We reserve the right to suspend or block any account suspected of violating these policies without prior notice.

7. LIMITATION OF LIABILITY AND INDEMNITY

In no event shall MOBICELL INDIA PRIVATE LIMITED be liable for any indirect, punitive, incidental, special, or consequential damages. Our total liability for any claim arising out of the Services shall not exceed the transaction amount or ₹500, whichever is lower.

You agree to indemnify and hold the Company harmless from any claims, losses, or damages resulting from your breach of these Terms or your use of the Services.

8. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and constructed in accordance with the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Deoghar, Jharkhand only.
